for the provision of pilates instruction services

(pursuant to Sections 6:77-81 of Act V of 2013 on the Civil Code)

I. DEFINITIONS

For the purposes of these General Terms and Conditions (hereinafter: "GTC"), the following terms shall have the meanings set forth below:

"Service Provider" means the RoseHill Pilates studio operated by dr. Lívia Tácsik, sole proprietor.

"Client" means any natural person who utilises the pilates instruction services of the Service Provider. For the purposes of these GTC, the Client shall be deemed a consumer within the meaning of Section 8:1(1)(3) of the Civil Code.

"Class" means a single pilates session of fifty (50) minutes in duration, conducted in person by a qualified instructor at the Studio.

"Group Class" means a pilates class conducted with a maximum of six (6) Clients participating simultaneously.

"Private Individual Class" means a privately arranged pilates class with a maximum of one (1) Client.

"Private Duo Class" means a privately arranged pilates class with a maximum of two (2) Clients.

"Private Trio Class" means a privately arranged pilates class with a maximum of three (3) Clients.

"Booking System" means the online appointment booking platform operated by the Service Provider (rosehillpilates.com) through which Clients may register for Classes.

"Deposit" means the amount payable online upon confirmation of the booking, which constitutes part of the total class fee.

"On-Site Fee" means the amount payable at the Studio at the time the Class is held.

"House Rules" means the set of rules governing the use of the Studio, which constitutes Annex 1 to these GTC.

II. GENERAL PROVISIONS

1.     These GTC shall apply to all legal relationships arising between the Service Provider and the Client in connection with the provision of pilates instruction services.

2.     By submitting a booking through the Booking System and paying the Deposit, the Client acknowledges that they have read and accepted these GTC and the House Rules and considers them binding upon themselves.

3.     The contract between the Service Provider and the Client shall be concluded upon confirmation of the booking and payment of the Deposit. The contract shall not constitute a written agreement and shall not be filed by the Service Provider.

4.     The Service Provider reserves the right to unilaterally amend these GTC. The Service Provider shall notify Clients of any amendments by publishing them on the website. The amendments shall apply to new bookings made after publication.

5.     Matters not regulated in these GTC shall be governed by the provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001 on Certain Aspects of Electronic Commerce Services and Information Society Services, and Government Decree 45/2014 (II.26.) on the Detailed Rules of Contracts between Consumers and Businesses.

III. SERVICES AND PRICES

D) Right to Modify Prices

The Service Provider reserves the right to modify prices. Price changes shall apply to new bookings made after publication on the website; they shall not affect previously confirmed bookings.

IV. BOOKING AND PAYMENT

A) Booking Procedure

1.     The Client shall select the desired Class date and type through the Booking System.

2.     The Client shall provide the required booking information (name, email address, telephone number).

3.     The Client shall accept these GTC and the Privacy Policy.

4.     The Client shall pay the Deposit online by bank card through the Barion Payment Zrt. payment system.

5.     Following successful payment, the Service Provider shall confirm the booking by email without undue delay but no later than within forty-eight (48) hours.

B) Payment Methods

Payment shall be made in two instalments:

•       Deposit: payable upon confirmation of the booking, by online bank card payment (Barion);

•       On-Site Fee: payable at the time the Class is held, in cash or by bank card (SumUp terminal).

Online payments are processed by Barion Payment Zrt. (registered office: 1117 Budapest, Infopark sétány 1.; MNB licence number: H-EN-I-1064/2013). On-site card payments are facilitated by SumUp EU Payments UAB (registered office: Ukmergės g. 126, 08100 Vilnius, Lithuania; Bank of Lithuania licence number: 56).

V. EXCLUSION OF THE RIGHT OF WITHDRAWAL

The Client acknowledges that, pursuant to Section 29(1)(l) of Government Decree 45/2014 (II.26.) on the Detailed Rules of Contracts between Consumers and Businesses, in the case of contracts for services relating to leisure activities where the contract specifies a specific date or period of performance, the consumer shall not be entitled to the right of withdrawal without giving reasons.

A pilates class constitutes a leisure service for a specified date; accordingly, following confirmation of the booking and payment of the Deposit, the Client shall not be entitled to withdraw from the contract and shall not be entitled to the fourteen (14) day right of withdrawal without giving reasons.

However, the Client shall be entitled to utilise the cancellation and rescheduling options set out in Section VI hereof.

VI. CANCELLATION AND RESCHEDULING

A) Cancellation Rules

1.     The Client may reschedule the booked Class to another date free of charge through the Booking System no later than twenty-four (24) hours before the scheduled start of the Class.

2.     If the Client cancels the Class within twenty-four (24) hours of the scheduled start time, the Deposit shall be forfeited and may not be transferred to another date.

3.     In the event of rescheduling, the Client shall only pay the On-Site Fee upon attending the rescheduled Class; the Deposit need not be paid again.

B) Force Majeure

In the case of extraordinary circumstances beyond the Client's control and which could not have been foreseen (serious illness, accident), the Client may transfer the Deposit to a later date, provided that the Client provides credible evidence of the reason for cancellation (e.g., medical certificate). The Service Provider shall exercise discretion in assessing force majeure cases.

In the event of force majeure (natural disaster, epidemic, official measures), the Service Provider reserves the right to modify or cancel Classes. In such cases, the Service Provider may transfer the Deposit to a new date, but no monetary refund shall be made.

C) Cancellation by the Service Provider

If the Service Provider is unable to hold the Class for any reason, it shall notify the Client without delay, and the Client may reschedule the Deposit to another date.

VII. NO-SHOW AND LATENESS

1.     If the Client fails to attend the booked Class without prior cancellation, the Deposit shall be forfeited.

2.     The Client's lateness shall not extend the duration of the Class.

3.     If the Client is more than ten (10) minutes late, the Service Provider may consider the Class as held, and the Deposit shall be forfeited. The Service Provider may allocate the place to another Client.

4.     In the event of lateness, the Client may join the Class quietly without disturbing the group, provided the lateness does not exceed ten (10) minutes.

VIII. HEALTH DECLARATION AND CLIENT OBLIGATIONS

A) Health Fitness

1.     The Client declares that they are in a state of health suitable for participation in the Class and that, to their knowledge, they have no health conditions or contraindications that would preclude or restrict the performance of pilates exercises.

2.     The Client shall inform the instructor before the start of the Class of any circumstances (illness, injury, pregnancy, surgery, medication, high blood pressure, heart condition) that may affect the safe performance of the exercises.

3.     If the Client experiences discomfort or pain during the Class, they shall immediately notify the instructor.

4.     Based on the information provided, the instructor shall be entitled to refuse to hold the Class if the Client's state of health does not permit training. In such cases, the Client may transfer the Deposit to a later date.

5.     The services of the Service Provider may be used solely at the Client's own risk.

B) Attire and Hygiene

1.     Appropriate sportswear and non-slip pilates socks are recommended for Classes. Close-fitting clothing facilitates the instructor's verification of proper exercise execution.

2.     Upon arrival at the Studio, the Client shall remove their outdoor footwear and place it in the designated area.

3.     The Client shall bring a towel to the Class; unfortunately, we are unable to provide towels.

4.     At the end of the Class, the Client shall clean the equipment and machines used with the disinfectant provided by the Studio.

C) Equipment Use

1.     The Client may use the Studio's equipment and machines for their intended purpose and only under the direction of the instructor.

2.     The machines may not be used independently without supervision.

3.     The Client shall immediately report any equipment damage or defect to the instructor.

D) Conduct Rules

1.     The Client shall behave courteously and respectfully towards other clients present in the Studio, instructors, and staff.

2.     The Client shall mute or switch off their mobile phone before the Class.

3.     Rude, offensive, harassing, or disrespectful conduct may result in exclusion from the Studio.

IX. PROHIBITIONS

The following activities and items are prohibited on the Studio premises:

•       smoking;

•       consumption of alcohol;

•       consumption of or abuse of drugs, prohibited doping substances, and narcotics;

•       bringing any dangerous substances and/or objects (firearms, ammunition, explosives, pyrotechnic devices);

•       bringing animals (except guide dogs, assistance dogs, or therapy dogs);

•       any activity that disturbs others with excessive noise, odour, or other environmental nuisance;

•       taking photographs or videos without the Service Provider's permission;

•       commercial activities, advertising, or distribution of promotional materials without the Service Provider's written permission;

•       any activity that contravenes legislation or public morality.

X. LIABILITY

1.     The Service Provider shall be liable for the professional and safe provision of services, for the proper maintenance of the Studio's equipment, and for compliance with the applicable safety regulations.

2.     Having regard to Section 6:152 of the Civil Code, the Service Provider does not exclude or limit its liability for breach of contract caused intentionally or by gross negligence, or for damage to human life, physical integrity, or health.

3.     The Service Provider shall not be liable for the loss of or damage to personal belongings brought into the Studio by the Client. Valuables are brought at the Client's own risk.

4.     The Service Provider shall not be liable for injuries resulting from health conditions concealed by the Client, failure to follow the instructor's instructions, or improper use of equipment.

5.     The Client shall be fully liable for damages caused intentionally or negligently to the Studio's equipment and furnishings.

Lost and Found Items

Lost or found items left in the Studio shall be retained by the Service Provider for a maximum of fourteen (14) days. Thereafter, the Service Provider shall decide on the disposal of such items.

XI. CCTV SYSTEM

1.     The Client acknowledges that a CCTV system operates on the Studio premises for the purposes of property protection and personal safety.

2.     One (1) camera operates in the Studio, positioned above the fireplace, recording the entire pilates room. The camera does not record the changing room, toilet, or shower area.

3.     The purposes of processing recordings made by the CCTV system are: property protection, personal safety of Clients and persons present, protection of pilates equipment, and prevention and evidencing of unlawful acts.

4.     The legal basis for processing is legitimate interest pursuant to Article 6(1)(f) of the GDPR.

5.     The retention period for recordings is seventy-two (72) hours, with automatic overwriting, except where the recording serves as evidence in judicial or official proceedings.

6.     Access to the recordings is limited to the Service Provider and, in cases prescribed by law, the competent authorities.

7.     By confirming the booking, the Client acknowledges the operation of the CCTV system.

XII. DATA PROCESSING

1.     The Service Provider processes the personal data of Clients in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information.

2.     The detailed rules of data processing are set out in the Service Provider's Privacy Policy, which is available at rosehillpilates.com.

3.     During online payment, Barion Payment Zrt. processes the data necessary for the transaction as an independent data controller. The Barion Privacy Policy is available at: https://www.barion.com/hu/adatvedelmi-tajekoztato/

XIII. COMPLAINTS

A) Submitting Complaints

•       The Client may submit complaints orally (in person at the Studio) or in writing (by email to rosehillpilates@gmail.com).

•       The Service Provider shall examine oral complaints immediately and remedy them as necessary. If the Client disagrees with the handling of the complaint, the Service Provider shall prepare a record of the complaint and its position thereon.

•       The Service Provider shall provide a substantive response to written complaints within thirty (30) days. In the event of rejection, the Service Provider shall send a reasoned response containing information on available remedies.

B) Conciliation Body

If a consumer dispute arising between the Service Provider and the Client cannot be settled amicably, the Client may apply to the conciliation body at their place of residence or habitual residence. The conciliation body with jurisdiction based on the Service Provider's registered office is:

XIV. FINAL PROVISIONS

1.     These GTC shall enter into force on 1 January 2026 and shall remain valid until revoked.

2.     Disputes between the Service Provider and the Client shall be governed by Hungarian law.

3.     The Parties shall endeavour to settle disputes arising from the contract primarily amicably through negotiation. In the event of failure, the Parties submit to the exclusive jurisdiction of the Buda Central District Court or, depending on subject-matter jurisdiction, the Budapest-Capital Regional Court.

4.     Matters not regulated in these GTC shall be governed by the provisions of Act V of 2013 on the Civil Code.

5.     Failure to comply with the House Rules (Annex 1 to these GTC) may result in refusal of service and exclusion from the Studio.
